These are the Terms and Conditions of Smeaton Devine Pty Ltd trading as “Devine’s Guide” (“Devine’s Guide”) on the website located at www.devinesguide.com.au which is owned and operated by Devine’s Guide.  These include the Terms of Use, Disclaimer and Privacy Policy which can also be found on our website.  Please read these carefully, as they apply to all transactions between us and can only be waived or varied in writing.  By purchasing a product/s through Devine’s Guide, you are confirming that you have read, understood and agreed to these conditions.  If you have any queries about these conditions or any purchase, please email Devine’s Guide.

1. All purchases and contracts to purchase from Devine’s Guide are governed by the laws of Victoria.  By purchasing from this online website you submit to the exclusive jurisdiction of the courts of Victoria.

2. The goods and services sold by Devine’s Guide are only available for sale to persons who can make legally binding contracts.

3. Devine’s Guide products are being purchased for personal or business use and shall not be purchased for commercial resale.

4. You may offer to purchase goods or services described in the Devine’s Guide website (“website”) for the price specified on the website.  Your order must contain the order information required by the website, including your name, address and payment details.  Devine’s Guide will not be liable for any orders that go missing due to incorrect delivery information.  Devine’s Guide may accept your offer at its discretion.

5. Title in the goods and services does not pass to you until full payment has been received and cleared.  Risk of loss or damage to the goods passes to you on despatch.  Unless otherwise agreed, Devine’s Guide is not responsible for damage to goods arising from acts of God or unforeseen hazards, or from another person’s failure to ensure the goods are undamaged upon receipt.

6. Prices are in Australian dollars and include Goods and Services Tax.

7. Prices and shipping prices may change at any time. Shipping overseas will incur additional fees.  Devine’s Guide will charge the cheapest available international shipping, plus a handling fee.  For international pricing, please email us.

8. Devine’s Guide acknowledges that stock levels and availability may change from time to time.  Devine’s Guide will use its best endeavours to ensure you receive your product as soon as practicable.  You acknowledge that shipping times may vary and be outside the control of Devine’s Guide.

Copyright in all Devine’s Guide products (including the website) is owned by Devine’s Guide.  Apart from any use as permitted under the Copyright Act 1968, no part may in any form or condition by any means (electronic, mechanical, microcopying, photocopying, recording or otherwise) be reproduced, stored in a retrieval system, or transmitted without prior written permission.

Whilst using our best endeavours to ensure that data transmitted over the internet is secure, you acknowledge that any information you transmit to Devine’s Guide is transmitted at your own risk.  Devine’s Guide will take all reasonable steps to ensure your data is secure.
